1. Introduction

Welcome to ARM Travel, a DBA of BWJ Travel, LLC ("ARM Travel," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the ARM Travel platform, website, and related services (collectively, the "Platform"). By creating an account, subscribing, or using any portion of the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Service Description

ARM Travel is a subscription-based membership platform that provides members with access to wholesale and deeply discounted rates on travel products and services, including hotels, flights, car rentals, and activities (collectively, "Travel Services"). ARM Travel acts solely as a marketplace aggregator and referral service. All actual bookings, reservations, and transactions for Travel Services are fulfilled by independent third-party travel suppliers, booking engines, and service providers ("Third-Party Providers"). ARM Travel does not own, operate, manage, or directly control any hotel, airline, car rental company, or activity provider. The Platform provides the connection and access to pricing not otherwise available to the general public — it does not itself sell travel products.

3. Membership & Account Registration

3.1 Eligibility

You must be at least 18 years of age to register for an account and use the Platform. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

3.2 Account Responsibilities

By creating an account, you agree to:
- Maintain the confidentiality of your account login credentials
- Notify ARM Travel immediately of any unauthorized access to your account at support@armtravel.co
- Accept full responsibility for all activity that occurs under your account
- Not share your account access with any third party
- Comply with all applicable laws and regulations when using the Platform

3.3 Account Cancellation

You may cancel your membership at any time by contacting us at support@armtravel.co. Cancellation takes effect at the end of your current billing period unless otherwise required by law.

4. Subscription, Fees & Billing

4.1 Subscription Plans

Access to the Platform requires a paid subscription. Current subscription plans, pricing, and billing intervals are displayed on the ARM Travel website and may be updated from time to time. Your continued use of the Platform following a pricing change constitutes acceptance of the updated pricing.

4.2 Billing

Subscription fees are billed on a recurring basis (monthly, quarterly, or annually, depending on the plan selected) via your chosen payment method. You authorize ARM Travel to charge your payment method on a recurring basis until you cancel. Failure to maintain a valid payment method on file may result in suspension or termination of your account.

4.3 Refund Policy

All subscription payments are final and non-refundable, except as expressly required by applicable law. If you believe a charge was made in error, you must contact us at support@armtravel.co within 7 days of the charge date. Refund requests outside of this window will not be considered. ARM Travel reserves the right to evaluate all refund requests on a case-by-case basis.

4.4 Free Trials

If a free trial is offered, it will be clearly disclosed at the time of sign-up, including the trial duration and the subscription fee that will automatically begin at the end of the trial period unless you cancel before the trial expires.

5. Wholesale Pricing & Third-Party Bookings

5.1 Nature of Pricing

ARM Travel provides members with access to wholesale, member-only, and discounted travel rates sourced from various Third-Party Providers. These rates are made available solely for personal, non-commercial use. ARM Travel does not guarantee the availability, continuity, or accuracy of any rate or deal displayed on the Platform.

5.2 Third-Party Booking Responsibility

When you click through to book a Travel Service, you will be redirected to or connected with a Third-Party Provider's booking platform. All bookings, reservations, contracts, and financial transactions occur directly between you and the relevant Third-Party Provider. ARM Travel is not a party to any booking transaction and is not responsible for:
- Booking confirmations, modifications, or cancellations
- Hotel, airline, car rental, or activity quality and performance
- Pricing errors, availability discrepancies, or last-minute changes
- Third-Party Provider fees, surcharges, or additional charges
- Any disputes arising from your booking or travel experience

5.3 Third-Party Terms

Your use of any Third-Party Provider's services is governed exclusively by that provider's own terms and conditions, cancellation policies, and privacy policies. ARM Travel is not responsible for, and does not endorse, any Third-Party Provider. You should review each provider's terms carefully before completing any booking.

6. Prohibited Activities

You agree not to use the Platform to:
- Resell, redistribute, or commercially exploit wholesale rates or Platform access
- Misrepresent your identity or affiliation
- Engage in unauthorized access, scraping, crawling, or data harvesting
- Upload or transmit malware, viruses, or malicious code
- Attempt to reverse engineer, copy, or create derivative works of the Platform
- Circumvent any security, authentication, or access control measure
- Violate any applicable local, state, national, or international law or regulation
- Post or transmit false, misleading, or fraudulent information
- Interfere with the operation or availability of the Platform or its servers

7. Intellectual Property

The ARM Travel Platform, including its design, software, content, logos, trademarks, and all related intellectual property, is owned by BWJ Travel, LLC or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal, non-commercial membership purposes. The ARM Travel name, logo, and related marks may not be used without prior written permission.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARM TRAVEL DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- That the Platform will be uninterrupted, error-free, or secure
- That travel pricing, availability, or deal information will be accurate or current
- That defects or errors will be corrected

ARM Travel does not warrant or guarantee any specific savings, pricing outcomes, or travel experiences obtained through use of the Platform.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BWJ TRAVEL, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO:
- Your use of or inability to use the Platform
- Any booking made through or facilitated by the Platform
- The acts or omissions of any Third-Party Provider
- Pricing inaccuracies, booking errors, or travel service failures
- Unauthorized access to or alteration of your data
- Any other matter relating to the Platform or ARM Travel's services

IN NO EVENT SHALL ARM TRAVEL'S AGGREGATE LIABILITY TO YOU EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU TO ARM TRAVEL DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless BWJ Travel, LLC, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any bookings made through the Platform.

11. Termination

ARM Travel reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to a violation of these Terms, non-payment, or fraudulent or abusive conduct. Upon termination, your right to use the Platform ceases immediately.

12. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform, the parties agree to first attempt to resolve the matter through good-faith informal negotiation for a period of 30 days. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in the United States, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's award shall be final and binding.

CLASS ACTION WAIVER: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which BWJ Travel, LLC is incorporated, without regard to conflict of law principles.

14. Modifications to Terms

ARM Travel reserves the right to modify these Terms at any time. When we make material changes, we will notify users via email or a prominent notice on the Platform, and update the "Last Updated" date. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Terms.

15. Force Majeure

ARM Travel shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, government actions, acts of war, terrorism, pandemic, regulatory changes, or infrastructure failures.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with ARM Travel's Privacy Policy and any other legal notices published by ARM Travel on the Platform, constitute the entire agreement between you and BWJ Travel, LLC regarding the use of the Platform.
